Terms of sale
The terms that apply when you buy from FACETORI.
Who we are
FACETORI is a brand of HELLO MOLLY PTY LTD, an Australian proprietary company (ACN 158 264 076, ABN 91 158 264 076), 74 O’Riordan St, Alexandria NSW 2015, Australia (“we”, “us”). Contact: support@facetori.shop, +61 425 944 353, Monday to Friday 9:00–17:00 Sydney time.
Scope
These terms apply to every order placed on facetori.shop by a consumer. They are available in English, German, Danish, Swedish, French and Dutch; you can read and save them before ordering. Nothing in these terms limits any right you have under the mandatory consumer law of the country where you live.
Who can order
You must be at least 18 years old and order as a consumer for personal use. We sell to the countries listed on Delivery & import charges. We do not sell for resale.
Products and photos
Each product page describes the piece, its bead material, size, weight, load, contents of the parcel and safety information. Our photos show the actual design. Faceted glass, acrylic and resin look different in different light, and screens show colour differently, so small variations in tone are normal and are not a fault. Items shown alongside a product in a photo (for example a strap on a bag) are sold separately unless the product page says they are included.
Prices and currencies
- Prices are set in US dollars and converted into the currency you choose with exchange rates we set and update from time to time. The price shown in your chosen currency is the price we charge, and you are charged in that currency.
- For Australian delivery addresses, prices include 10% GST. For other countries, prices do not include import VAT, customs duty or carrier handling fees, which may be charged by your country on delivery (see Delivery & import charges).
- Delivery costs are shown in your basket and at checkout before you pay.
- If a price on the site is obviously wrong because of a technical error, we will tell you before dispatch and you can confirm the order at the correct price or cancel it for a full refund.
How the contract is made
- You add pieces to your bag and go to checkout, where you enter your details and choose delivery and payment.
- Before ordering you can review and correct every entry. By pressing Place order and pay you make a binding offer to buy the items in your bag.
- We send an automatic email confirming receipt of your order. The contract is concluded when we accept your order, which we do by sending the order confirmation email after your payment has been authorised.
- We store the contract text. You receive the order details and these terms by email; you can also find your orders in your account if you created one.
Payment
The payment methods available are shown at checkout. Payments are processed by a PCI DSS-compliant payment provider over an encrypted connection; we never see or store your full card number. Your card is charged when you place the order. Your statement shows FACETORI.
Delivery, risk and ownership
We dispatch within 1–3 business days. Delivery times are listed on Delivery & import charges. Risk in the goods passes to you when you, or a person you name, take physical possession of them. Ownership passes to you on full payment.
Returns, withdrawal and cancellation
You can cancel free of charge until dispatch. You can return unused items within 30 days under our voluntary returns promise. Customers in the EU, EEA and UK have a 14-day statutory right of withdrawal; the full information, including the model withdrawal form, is on Returns & refunds, and you can withdraw online at Withdraw from contract.
Consumer guarantees and legal guarantee
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
If you live in the EU, EEA or UK, the statutory legal guarantee of conformity under the law of your country also applies. We do not give any additional commercial warranty.
Liability
We are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care. We do not exclude or limit our liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, for fraud, or under the Australian Consumer Law or other mandatory consumer law. Our pieces contain small parts and are not suitable for children under 3; please follow the safety and care information.
Promotions
We do not currently run discount codes, sales or promotions. If we ever do, the conditions will be shown with the promotion.
Events outside our control
If something outside our reasonable control delays your order, we will tell you as soon as possible. If the delay is long, you can cancel and receive a full refund.
Personal information
We use your personal information as described in our Privacy policy.
Governing law and disputes
These terms are governed by the law of New South Wales, Australia. If you are a consumer living in another country, you also keep the protection of the mandatory provisions of the law of your country, and you may bring proceedings in the courts of your country.
If you have a complaint, please contact us first; we answer within one business day and aim to resolve every complaint within 14 days. Australian customers can also contact NSW Fair Trading. We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.
Changes
We may update these terms. The version in force when you place your order applies to that order.
